Panomap — Terms of Service
These Terms of Service ("Terms") govern your access to and use of Panomap, a georeferenced panoramic imagery hosting and delivery platform ("Platform") operated by East-SouthEast, LLC ("we," "us," or "our"). By creating an account or using the Platform in any way, you agree to these Terms.
1. Acceptance of Terms
By registering for an account, uploading content, or accessing any feature of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.
2. Description of Service
Panomap allows registered users ("Uploaders") to upload, host, and share georeferenced panoramic imagery. Imagery is displayed on an interactive map and can be made publicly accessible or restricted via access codes. The Platform is provided as a subscription-based service with tiered storage plans.
3. Accounts
- You must provide a valid email address and maintain accurate account information.
- You are responsible for maintaining the security of your account credentials.
- You may not share your account with others or create accounts on behalf of others without authorization.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Ownership of Content
You retain full ownership of all images and data you upload to the Platform ("Your Content"). By uploading content, you grant East-SouthEast, LLC a limited, non-exclusive license to store, display, and deliver Your Content solely for the purpose of operating the Platform on your behalf. We do not claim any ownership rights in Your Content.
5. Uploader Responsibilities
You are solely responsible for all content you upload. You represent and warrant that:
- You own or have obtained all necessary rights, licenses, permits, and consents to upload and share the imagery, including rights related to the property depicted, drone or aerial photography regulations, and any applicable survey or access permissions.
- Your Content does not violate any applicable law, regulation, or third-party rights.
- Your Content does not contain illegal, obscene, vulgar, defamatory, threatening, harassing, or otherwise objectionable material.
- Your Content does not depict individuals or activities without appropriate authorization.
We strongly recommend that you blur or obscure faces and vehicle license plates in all uploaded imagery prior to upload. While we encourage this practice, the responsibility to comply with applicable privacy laws regarding identifiable individuals or vehicles rests solely with you.
6. Prohibited Content and Uses
You may not use the Platform to upload, share, or facilitate:
- Illegal content of any kind, including content that violates privacy, intellectual property, or criminal laws.
- Content intended to harass, threaten, defame, or harm any individual or group.
- Content depicting minors in any inappropriate context.
- Imagery captured through trespass or without lawful authorization.
- Any use that interferes with the Platform's operation or other users' access.
We reserve the right, but are not obligated, to review, remove, or restrict access to any content that we believe violates these Terms, at our sole discretion and without prior notice.
7. Access Codes and Sharing
You may restrict access to your projects using access codes. You are responsible for managing and distributing access codes. Share links and access codes are your responsibility — we are not liable for unauthorized access resulting from your sharing of codes or links with unintended recipients.
8. Subscription Plans and Billing
Access to the Platform beyond the free tier requires a paid subscription. Current plan details, storage limits, and pricing are displayed in the Billing section of the Platform.
- Subscriptions are billed monthly and renew automatically until cancelled.
- Active storage that exceeds your plan's included storage is billed at the overage rate for your tier.
- Archived projects are billed at a flat rate of $0.25 per GB per month, separate from your plan's active storage.
- Plans may auto-upgrade when your storage usage crosses a threshold where the next tier becomes more cost-effective. You will never be charged more than the optimal rate for your usage.
- Price increases will be announced on the first of a calendar month and take effect no sooner than the first of the second following month (minimum 30 days' notice). Price decreases take effect promptly upon announcement.
- All payments are processed through Stripe. By subscribing, you also agree to Stripe's terms of service.
9. Cancellation and Data Retention
You may cancel your subscription at any time through the Billing portal. Upon cancellation:
- Your account enters a 7-day grace period during which your projects remain accessible.
- If payment is not restored within the grace period, your account is flagged for deletion.
- All project data, including archived projects, is permanently deleted 37 days after cancellation or non-payment.
- Deleted data cannot be recovered. We strongly recommend maintaining local copies of all imagery.
We reserve the right to terminate accounts that violate these Terms, with or without prior notice.
10. Platform Availability
We strive to maintain consistent availability of the Platform but do not guarantee uninterrupted service. The Platform relies on third-party infrastructure including Cloudflare, Supabase, and Stripe. Scheduled or unscheduled maintenance, third-party outages, or other circumstances may cause temporary unavailability. We are not liable for any losses resulting from Platform downtime.
11. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, EAST-SOUTHEAST, LLC DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We are not responsible for:
- The content, accuracy, or legality of any imagery uploaded by users.
- Any loss of data resulting from account termination, service interruption, or user error.
- Any claims arising from your upload or sharing of imagery, including privacy claims related to identifiable persons or vehicles.
- Any third-party claims related to Your Content.
IN NO EVENT SHALL EAST-SOUTHEAST, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
12. Indemnification
You agree to indemnify and hold harmless East-SouthEast, LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, Your Content, your violation of these Terms, or your violation of any third-party rights.
13. Transfer or Sale of Platform
East-SouthEast, LLC reserves the right to sell, transfer, or assign the Platform and its associated subscriptions to a third party. In the event of such a transfer, existing subscriptions will be honored through the end of the then-current billing period. Any changes to these Terms following a transfer are the responsibility of the new owner, and East-SouthEast, LLC bears no liability for terms or practices implemented after the date of transfer.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Barnstable County, Massachusetts.
Panomap — Privacy Policy
This Privacy Policy describes how East-SouthEast, LLC ("we," "us," or "our") collects, uses, and protects personal information when you use Panomap ("Platform"). By using the Platform, you agree to the practices described in this Policy.
1. Information We Collect
- Account Information: Your email address and password (stored securely via Supabase Auth). Optionally, your name and company name.
- Billing Information: Payment is processed by Stripe. We do not store credit card numbers. We retain your Stripe customer ID and subscription status.
- Usage Data: Storage usage, upload activity, project count, and subscription tier. High-water mark storage values used for billing calculations.
- Content Metadata: Project names, locations, descriptions, dates, and image counts associated with your uploaded projects.
- Session Data: Authentication tokens stored in your browser's local storage to maintain your session.
2. Information We Do Not Collect
- We do not access or analyze the content of your uploaded panoramic images.
- We do not sell your personal information to third parties.
- We do not serve advertising or share data with advertising networks.
3. How We Use Your Information
- To provide, operate, and maintain the Platform.
- To process payments and manage your subscription.
- To calculate storage usage and generate billing charges.
- To communicate with you about your account, billing, and Platform updates.
- To enforce our Terms of Service.
4. Data Sharing
We share limited personal data with the following third-party service providers solely to operate the Platform:
- Supabase (supabase.com) — authentication, database, and user record storage.
- Stripe (stripe.com) — payment processing and subscription management.
- Cloudflare (cloudflare.com) — image storage (R2), content delivery, and worker functions.
We do not share your personal data with any other third parties except as required by law.
5. Data Retention
We retain your account data for as long as your account is active. Upon account deletion or termination:
- All uploaded imagery and project data is permanently deleted within 37 days.
- Billing records may be retained for up to 7 years as required by applicable tax and financial regulations.
- Email addresses may be retained for a reasonable period for legal compliance purposes.
6. EU Users — GDPR
If you are located in the European Union or European Economic Area, you have the following rights under the General Data Protection Regulation (GDPR):
- Right of Access: You may request a copy of the personal data we hold about you.
- Right to Rectification: You may request correction of inaccurate personal data.
- Right to Erasure: You may request deletion of your personal data, subject to legal retention requirements.
- Right to Restriction: You may request that we restrict processing of your data in certain circumstances.
- Right to Data Portability: You may request your data in a machine-readable format.
- Right to Object: You may object to processing of your personal data in certain circumstances.
To exercise any of these rights, contact us at info@ese-llc.com. We will respond within 30 days. The legal basis for processing your data is the performance of our contract with you (subscription services) and our legitimate business interests (fraud prevention, security, billing accuracy).
As a US-based operator serving EU users, we transfer data to the United States. By using the Platform, you consent to this transfer. We use service providers (Supabase, Stripe, Cloudflare) that maintain appropriate data protection safeguards.
7. California Users — CCPA
If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of personal information. 8. Security
We implement industry-standard security measures including encrypted data transmission (HTTPS), secure authentication via Supabase, and access-controlled cloud storage via Cloudflare R2. However, no system is completely secure, and we cannot guarantee the absolute security of your data.
9. Cookies and Local Storage
The Platform uses browser local storage to maintain your authentication session. We do not use third-party tracking cookies or advertising cookies. Mapbox, our map provider, may set cookies in accordance with their own privacy policy.
10. Children's Privacy
The Platform is not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, contact us and we will delete it promptly.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated via email or Platform notice. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Policy.
